Completion of Contract Work
Substantial Completion of Work:
Substantial Completion of Work or designated
portion thereof shall be that date, certified by the
Architect, when the construction is sufficiently complete
in accordance with the Contract Documents, so the Owner
can occupy or utilize the Work or designated portion
thereof for the use for which it is intended. Substantial
Completion shall occur:
- After the Contractor submits a list of items to
be completed or corrected to the Architect.
- On the basis of the Architect's subsequent
inspection of the premises.
- When the Architect issues a Certificate of
Substantial Completion establishing the date of
Substantial Completion, and stating the
responsibilities of the Owner and the Contractor
for security, maintenance, heat, utilities,
damage to the Work, and insurance, and shall fix
the time within which the Contractor shall
complete the items listed therein.
Final completion:
Upon receipt of written notice that the Work is
ready for final inspection and acceptance and upon
receipt of a final Application for Payment, the Architect
will promptly make such inspection and, when he finds the
Work acceptable under the Contract Documents and the
Contract fully performed, he will issue a final
Certificate for Payment stating that the Work has been
completed in accordance with the terms and conditions of
the Contract Documents and that the entire balance due
the Contractor, and noted in said final Certificate, is
due and payable. The final Certificate for Payment will
constitute a representation that the conditions precedent
to the Contractor's being entitled to final payment have
been fulfilled.
